Any predictions on the justices' votes/opinions? Scalia pretty much made his stand clear. He brought up alot of interesting points but he seemed rather unprofessional, as if he intended to help out the plantiff. I'd say Kennedy and Rehnquist will vote in favor of the plantiff... I don't know about the rest though.

"The Harvard plan" was brought up alot... what is it?

another note... listening to the arguements really made the justices seem more human. They had always seemed so high and godly before.

I also loved hearing the flowing arguments of the lawyers and how they were kept on their feet by the justices. It was almost like watching the British House of Commons (now that is quality entertainment). God save C-SPAN!

Best guess: 5 to 4 in favor of the school with slim possibility that undergrad "extra 20 point" system (but not law school "additional factor" system) might be overruled. O'Connor, Breyer, Ginsburg, Stevens, and Souter in the majority, and Rehnquist, Kennedy, Thomas and Scalia in the minority. Scalia is not unprofessional and was just playing a very common game for the judges when they are hearing a case over which they are quite divided -- trying to get the other judges (particularly in this case O'Connor who is the swing vote) to listen to his arguments by guiding the party he favors into making them.

true... I didn't realize that the justices often use questions/comments to the arguing lawyers in order to make their points to the other justices.
