They are already fined because when you buy a recyclable item like a platic bottle, you pay for the bottle and only get that back if you return it.

Unfortunately, not all states have bottle deposit regulations. I think one of the few practical ways to "enforce" recycling is to charge for garbage pickup by the bag, but have anything placed in the appropriate recycling receptacle taken free, although I guess that would mean that some people would dump their garbage elsewhere.
