my custodial parent didnt file taxes because they didn't earn anything. is this legit? and what should we do just sign a statment saying they didn't file and say that it was because no income was earned?

If you didn't file taxes because of zero income, there is a letter that you would receive from the IRS verifying that your parent is a non-filer.

my custodial parent called for information on whether or not to file and they said you dont have to file if its below a certain amount, but we never received that letter... any advice on what to do?

There are many instances when one would file a return even if there is no income. I would suggest looking down the long checklist that the IRS provides---called something like "Who should file".
